Perhaps you are a lawyer, or trust one that you wish to recommend, regarding the distribution of printed materials by a third party.

Mr. Pants has self-published Zombocalypse Now, but Alliance has indicated interest in shipping it out and pimping it in its catalogue. They distribute goods to something like 2000 game stores. They also think Diamond might be interested in picking it up; and Diamond distributes to pretty much all comic book shops everywhere.

If anyone has had any experience (for good or for ill) with these agencies, kindly speak out, man.

I am by NO MEANS an expert. But I'm reasonably sure Diamond will want exclusive rights. A few years ago then my husband was trying to self publish, Diamond took its fees as a percentage of the sales. If they still use that system, of course it behooves them to have sole rights.

This was. *thinks* 2001. Internet sales of comics were less of thing. It's possible Diamond has restructured it's contracts to reflect that reality.

It shouldn't affect Amazon sales, but I haven't actually dealt with a situation like this in any professional capacity, so I don't know for sure.

The biggest pain in the neck with Diamond is that they won't distribute if you fail to garner $2500+ worth of orders. And that $2500 is calculated on the payment they make to you after they take their 60-70$ off the top. So, if you have, ie, a $5 book and less than 715 copies are ordered, they don't ship -- even to the people who did order. And since they don't pay you your cut until after you have already printed and shipped your product to them, if they cancel for low orders you're out a hell of a lot of money.

I haven't heard of them demanding exclusivity. They're pretty in-your-face in the catalogue about the things they do exclusively carry, and it's a small portion of the total.

and we've talked abot that; previously our main concern was orders that would be "returned"; with Alliance, the books are absolutely sold, and they give you a six month purchase order, so we could fill it even if everybody decides to order a LOT of books.(g)

Just a note to say, when faced with a company, any company, who does things a certain way - as described in the comments by others, for example - it is always possible to say well, I want a /different/ deal, and here's what I'm prepared to offer and here's what I'm not prepared to sign away. Often they WILL be annoyed by these negotiations and they will say anything, even stupid shit like 'it's too hard to write up another contract' and of course, they'll blame their legal departments for tying their hands i,stead of admitting they don't WANT to negotiate terms -and yet, a contract is just that, a contract, and BOTH parties have to agree, and it's not because they make 90% of the people they deal with sign the same form contract that another one can't be drawn up.

I'm stressing it because it's very easy to forget. I've seen it happen.
